Information regarding the labour dispute 7.3.2018

The main contracting organisations of the university sector JUKO, Pardia and JHL have issued strike notice on 22.2.2018.

The targeted action will take place as a strike at Aalto University, Hanken School of Economics, University of the Arts Helsinki, Tampere University of Technology, University of Tampere, and University of Vaasa. Unless the negotiations reach an agreement, the strike is due to begin on 7.3.2018 at 00.00 and will continue for 24 hours. The negotiations are expected to continue throughout this week.

According to the strike notice all members of the Negotiation Organisation for Public Sector Professionals JUKO, the Federation of Salaried Employees Pardia and the Trade Union for the Public and Welfare Sectors JHL, to whom the universities’ collective agreement applies, will take part in the strike if it is realised. The strike is legal and all employees have the right to participate.

In general, no salary will be paid for the day of the strike due to the supposition that all the staff will be on strike. However, if the strike does not apply to you due to the restrictions mentioned below, or for some other reason you will be working during the strike, you will earn your normal salary for the day in question. If you for some reason will not participate in the strike, you will have to inform the employer to ensure there will be no deduction in your salary. In other words, if you do not inform the employer otherwise, the supposition is that you are participating in the strike and the salary for that one day will be deducted from your monthly pay. Your salary will be paid as usual on either 15 March or on 29 March, whether or not you take part in the strike. Hanken will look into the expected effects of the strike on the day-to-day activities to be able to inform students and staff about e.g. opening hours and teaching.

If the strike does not apply to you in accordance with the exceptions mentioned below, e.g. persons on a working trip abroad, you will also need to inform the employer of this in order to ensure your full salary. By requesting the staff to inform whether they are working during the strike, the employer does not seek to limit the employees’ right to organize or to participate in the strike. Instead, the purpose is to ensure that the members of staff who, for some reason, are not participating in the strike will receive their full salary.

FAQ

The following guidelines have been written in co-operation with the unions’ elected representatives at Hanken.

I am a member of the labour union and I will be taking part in the strike. What actions do I need to take and what are the consequences?

It is the employees' legal right to participate in the strike. To take part in the strike, no action is required on your part.

The employer is not obliged to pay salary to employees participating in the strike. The salary will be deducted only for the duration of the strike, which in this case will be 7.3.2018, if realised. Since the notification of strike applies to all employees who are members of any of the afore-mentioned organisations and to whom the universities' collective agreement applies (with a few exceptions mentioned below), the employer's supposition is that all the staff will participate in the strike unless otherwise indicated. In order to estimate the impact of the strike on the university’s activities and to ensure that the employees who are not participating in the strike will receive full salary, the employer will make an enquiry about who will be working during the strike. The labour unions will inform their members on how to proceed to apply for compensation for loss of income because of the strike.

How does the strike affect employees who are not members of any of the labour union mentioned above?

If your intention is to work instead of participating in the strike, please fill out the form in order to secure your full salary for the day of the strike. All employees have the right to take part in the strike, also when not a member of any union. No-one participating in the strike will receive salary for that day. The compensation for loss of income due to the strike will only be paid to union members.

I am a member of the union. Am I obliged to participate in the strike?

According to the strike notice, all members of JUKO, Pardia and JHL, to whom the universities’ collective agreement applies, will take part in the strike. Every employee will make their own decision whether to participate in the strike or not.

Is it possible to take a vacation day or “balance leave” on the day of the strike? Is it possible to work from home? (Applicable to administrative staff only)

If your application for vacation days or balance leave was approved before the strike notice was given 22.2.2028 you can take your leave as planned. The HR unit will check all vacations registered in ESS for the day in question. If you have agreed to be on balance leave, please send a copy of the approved application to humanresources@hanken.fi, and it will be registered accordingly by the HR unit. Any leave agreed upon after the date of the strike notice is not valid and the employee has to either participate in the strike or report to work as normal.

It is not possible to work from home on the day of strike. If you do not take part in the strike you will also have to report that you will be working.

If you participate in the strike on 7.3.2018, please register that day in Nepton as “Absence” (Poissaolo) and as Type of absence choose “Other” (Muu).

Sick leave and temporary childcare leave

If you fall ill before the strike starts, that is before 7.3. at 00.00, you will be paid your salary for sick leave as usual. However, this requires that you notify your manager or the HR unit about being ill before the beginning of the strike. You will also need a certificate from a nurse or a doctor already for the first day. If you fall ill during the strike, you will not receive salary for that day. If the illness continues after the day of the strike, you will receive salary for the sick leave in accordance with the general rules.

The same rules apply in case of temporary childcare leave. You will need to inform either your manager or the HR unit about the illness before the start of the strike and provide a nurse’s or doctor’s notice for the child’s illness for the day of the strike.

Teaching obligation during the strike

As a rule, all teaching will be cancelled during the strike. In case you will not be participating in the strike (and you have informed the employer using the form), please inform the students that the lecture or class will be taking place as scheduled and regardless of the strike. Please also take into account that the university’s opening hours could be affected by the strike and special arrangements needed regarding the access to classrooms or equipment.

Tasks not affected by the strike

According to the strike notice, all members of JUKO, Pardia and JHL, to whom the universities’ collective agreement applies, will take part in the strike. However, if realised, the strike will not affect the following:

  • Monitoring and corrective measures related to the IT-structure mentioned in the collective agreement (Chapter 4, 20 § of the collective agreement). Also, the strike will not affect such research tasks in which an interruption might cause significant damage.
  • Employees travelling abroad or participating in a conference (work related travelling).
  • In case of a public defence of a doctoral thesis, the doctoral candidate, the opponent, and the custos will not be affected by the strike.
  • The university’s Rector, the Deans and the HR Director.

JUKO has also announced that Akavan yleinen ryhmä ry will not be affected by the strike
